Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of OurFreedom.ai, including our websites, mobile applications, communities, facility search tools, AI tools, advertising-supported features, notification features, payment features, and related services (collectively, the "Platform").

The Platform is operated by Freedom Bail Fees, INC. ("OurFreedom.ai," "we," "us," or "our"). By creating an account, signing in, tapping "Agree," or otherwise using the Platform, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Platform.

2. Eligibility, Age, and Account Registration

You must have the legal capacity to enter into a binding agreement to use the Platform. In most jurisdictions, this means you must be at least 18 years old.

Where users aged 13-17 are permitted by law and Platform rules, use may be conditioned on legally valid parental or guardian consent. We may deny access, request verification, or suspend accounts where required by law, app-store rules, safety requirements, or our policies.

You agree to provide accurate, current, and complete account information and to keep it updated. You may not impersonate another person, incarcerated individual, attorney, court official, law enforcement official, business, organization, or other entity.

You are responsible for maintaining the confidentiality of your account credentials, authentication tokens, linked login providers, and device access. You must promptly notify us of any suspected unauthorized access or security issue.

3. Platform Overview

OurFreedom.ai provides support, community, communication, facility-related, advertising-supported, and AI-assisted tools for people affected by incarceration and related justice-system experiences.

The Platform may include feeds, communities, community search, posts, comments, direct messages or conversation features, user mentions, reporting, blocking, notifications, facility search, loved-one facility location, AI translation, AI-assisted content, payments, and sponsored or advertising content.

We may add, remove, change, suspend, or discontinue features at any time. Some features may not be available to all users or in all locations.

4. Required Loved-One Location / Facility Location Form

Every user is required to complete the Loved-One Location / facility location form as part of the app experience.

Users must review, update, or reconfirm their loved-one facility/location information every 6 months. This information helps support facility-related app functionality, community context, personalization, notifications, safety features, and advertising context.

The Loved-One Location feature does not collect precise GPS location from your device, and the app does not request iOS Location Services permission for this release. The feature collects user-selected or user-entered facility/city/state/address information.

Facility information may be provided by you, public sources, third-party place/search providers, or internal systems. Facility results may be incomplete, inaccurate, outdated, duplicated, or unavailable.

  • You are responsible for confirming facility information.
  • Manual facility entries may be reviewed, corrected, rejected, labeled as pending verification, or removed.
  • Facility search and place information may be subject to third-party terms and privacy policies, including Google Maps/Places terms where applicable.

5. User Content and Platform License

"User Content" includes posts, comments, direct messages, images, media, profile information, facility entries, reports, prompts, translations, mentions, reactions, and other content or materials you submit, upload, send, post, generate, or store through the Platform.

You retain ownership of your User Content, subject to the license granted in these Terms and any rights held by others.

To operate, secure, moderate, translate, improve, display, and distribute the Platform, you grant Freedom Bail Fees, INC. a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, display, transmit, translate, modify, adapt, and otherwise use your User Content as reasonably necessary for Platform functionality and related business purposes.

This license allows us to:

  • Host, store, and display posts, comments, profiles, and media.
  • Transmit messages, notifications, mentions, and other interactions.
  • Resize, crop, compress, transcode, or format content for technical, accessibility, safety, or display purposes.
  • Translate content using automated or AI-assisted tools.
  • Use content in aggregated, de-identified, or anonymized form for analytics, safety, and product improvement.

6. Communities, Community Search, and User Interactions

The Platform may include communities, community directories, community search, feeds, follows, mentions, likes, reposts, shares, comments, reports, blocking, and direct/conversation features.

Community membership, visibility, recommendations, search results, and feed ranking may be affected by account settings, safety rules, moderation decisions, language, facility context, and product logic.

Community content is user-generated or system-generated and may be inaccurate, incomplete, offensive, outdated, or unsuitable for your circumstances. We do not guarantee the accuracy or safety of user content.

7. Anonymous Posting

The Platform may allow anonymous posting or anonymous commenting in certain areas.

Anonymous posting may hide your display identity from other users, but it does not make your activity anonymous to OurFreedom.ai.

We may internally associate anonymous posts, comments, reports, moderation records, and related activity with your account for safety, support, enforcement, legal compliance, abuse prevention, and Platform integrity.

  • You may not use anonymous posting to harass, threaten, impersonate, defame, exploit, deceive, or evade moderation.
  • Anonymous content remains subject to all rules, reporting, retention, moderation, and enforcement policies.
  • We may disclose anonymous-content records when required by law, legal process, safety needs, or our policies.

8. Direct Messages and Conversation Features

The Platform may include direct messages, conversation features, or messaging-style interactions. Conversations may include participants, message content, message type, payload metadata, read state, deleted state, reactions, timestamps, and conversation list metadata.

The Platform does not provide end-to-end encryption. Content may be accessible to the Company and may be reviewed for safety, legal, support, moderation, or operational purposes as described in our Privacy Policy.

Do not use direct messages or conversation features for threats, harassment, illegal activity, contraband coordination, escape coordination, impersonation, spam, fraud, or any activity that violates these Terms.

9. Acceptable Use

You must use the Platform only for lawful, authorized, and acceptable purposes. You may not use or assist others in using the Platform in ways that:

  • Violate any law, regulation, court order, or third-party right.
  • Infringe intellectual property, privacy, publicity, or other rights.
  • Are threatening, harassing, hateful, discriminatory, defamatory, abusive, exploitative, sexually explicit, or otherwise unsafe.
  • Promote, coordinate, or facilitate violence, self-harm, fraud, contraband, escape, witness intimidation, or other illegal activity.
  • Share instructions or coded language for contraband, escape, evading facility rules, or evading lawful monitoring.
  • Impersonate another person or organization.
  • Scrape, harvest, copy, or extract user data at scale without authorization.
  • Use bots, fake accounts, automation, spam, or deceptive behavior without permission.
  • Reverse engineer, probe, overload, bypass, disrupt, or interfere with Platform systems.
  • Misuse reporting, blocking, moderation, age checks, consent flows, or safety controls.

10. Moderation, Reports, Blocking, and Enforcement

Content and activity may be reviewed by automated systems, AI tools, human reviewers, and third-party safety providers.

Moderation may include review of text, images, reports, profile data, account signals, metadata, prior enforcement history, and other context. Text moderation may use providers such as Hive. Image moderation may use AWS Rekognition or related safety systems.

We may:

  • Remove, hide, label, restrict, down-rank, or refuse content.
  • Warn, suspend, restrict, or terminate accounts.
  • Preserve moderation records, reports, and related evidence.
  • Refer matters to law enforcement, courts, facility officials, or other authorities when required or appropriate.
  • Act without prior notice where necessary to protect users, the Platform, or legal compliance.

Moderation systems are not perfect and may misclassify content. We may correct, reverse, or update moderation decisions at our discretion.

11. AI Systems, Translation, and Generated Content

The Platform may use artificial intelligence and automated systems for writing assistance, translation, moderation support, content generation, recommendations, ad context, search support, safety review, transcription, and user assistance.

AI-generated or AI-assisted outputs may be inaccurate, incomplete, unsafe, biased, outdated, or unsuitable for your situation. You are responsible for reviewing and editing AI-generated content before relying on it, posting it, sending it, or using it.

  • AI outputs do not constitute legal, financial, medical, mental-health, or professional advice.
  • Translations are provided for convenience only.
  • If a translated legal document conflicts with the English version, the English version controls.
  • Some community content may be generated, seeded, or assisted by automated systems or AI for engagement, testing, safety, onboarding, or community-building purposes.
  • AI decisions or automated systems may affect content visibility, recommendations, moderation, or access.

12. Advertising and Sponsored Content

The Platform may display sponsored content, native ads, banners, rewarded ads, interstitials, or other advertising.

Ads may be provided by third-party advertising networks or mediation partners, including Google AdMob / Google Mobile Ads, Meta ads, AppLovin, and related partners.

Ads may be selected or measured based on contextual information, app activity, device information, consent choices, advertising identifiers where permitted, facility or location context, language, and other information described in our Privacy Policy.

  • We do not endorse advertisers or guarantee third-party products, services, claims, offers, or content.
  • Advertising partners may have their own terms, privacy policies, consent tools, and data practices.
  • You may have advertising privacy choices in the app, device settings, or third-party consent flows.
  • App Tracking Transparency permission may be requested on iOS for advertising-related purposes, but tracking permission is optional and is not required for core app functionality.

13. Payments and Stripe

Where the Platform facilitates payments, subscriptions, service fees, bail-related assistance, mailing services, phone-related services, or other transactions, payments may be processed by third-party providers such as Stripe or other payment processors.

Payment providers may apply their own terms, privacy policies, fraud controls, verification requirements, refund rules, fees, and dispute procedures.

  • We do not guarantee availability of funds, legal outcomes, facility outcomes, delivery results, communication results, or third-party service availability.
  • Fees are non-refundable unless expressly stated or required by law.
  • You may not abuse payment, refund, credit, subscription, or chargeback systems.

14. Third-Party Services

The Platform depends on third-party services, infrastructure, software development kits, APIs, and providers.

These may include:

  • Apple, Google, and Microsoft authentication services.
  • Google AdMob / Google Mobile Ads, Meta ads, AppLovin, and related advertising partners.
  • Google Places / Google Maps or similar place-search providers.
  • Firebase and similar diagnostics/performance tools.
  • Stripe and other payment providers.
  • OpenAI and other AI providers.
  • Hive, AWS, AWS Rekognition, and other moderation or storage providers.
  • Cloud hosting, storage, push notification, analytics, support, and security providers.

Third-party services may collect, process, store, or receive data under their own terms and privacy policies. We are not responsible for third-party downtime, policies, fees, content, services, or changes.

15. No Legal Advice

OurFreedom.ai does not provide legal advice, legal representation, bail advice, attorney-client services, or professional services.

Community discussions, AI outputs, facility search results, generated content, translations, user posts, and Platform information are informational only and should not be relied upon as a substitute for professional advice.

Consult a qualified attorney or professional for advice about legal rights, court deadlines, criminal matters, bail, sentencing, appeals, immigration, probation, parole, or facility rules. Do not rely on the Platform for emergencies or time-sensitive legal action.

16. iOS Permissions and Mobile Platform Controls

This release does not require microphone, voice, or audio recording permissions. Voice/audio calling features are not active in this App Store build.

The app does not collect precise GPS location and does not request iOS Location Services permission.

Camera and photo library permissions may be requested only for profile photos, posts, and community content uploads.

App Tracking Transparency permission may be requested for advertising-related purposes, but tracking permission is optional and is not required for core app functionality.

Push notifications are optional and can be managed in app settings and device settings.

17. App Store, EULA, and Marketplace Terms

If you download the app through the Apple App Store or another app marketplace, your use may also be governed by that marketplace’s terms, usage rules, and license agreement.

For Apple App Store downloads, unless we provide a custom EULA through App Store Connect, Apple’s standard Licensed Application End User License Agreement applies in addition to these Terms.

You acknowledge that Apple and other app marketplaces are not responsible for the Platform or its content.

18. Intellectual Property

The Platform, software, design, trademarks, branding, logos, documentation, and related technology are owned by us or our licensors and are protected by intellectual property laws.

We respect copyright and may remove content that allegedly infringes another party’s rights. We may remove infringing content and terminate repeat infringers where appropriate.

19. Suspension, Termination, and Account Closure

We may suspend, restrict, or terminate your account or access for:

  • Violations of these Terms or our policies.
  • Legal, regulatory, safety, fraud, security, or operational requirements.
  • Abuse of the Platform, users, third-party services, or payment systems.
  • Risk to users, facilities, the public, or the integrity of the Platform.

Upon termination, access to the Platform is revoked. Your content may be deleted, hidden, retained, or preserved according to our Privacy Policy, safety needs, legal obligations, and enforcement policies.

20. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, RELIABILITY, ACCURACY, AND AVAILABILITY.

We do not guarantee uninterrupted service, error-free functionality, data preservation, ad availability, translation accuracy, AI accuracy, facility accuracy, payment success, notification delivery, content availability, or any legal, financial, personal, or facility-related outcome.

You use the Platform at your own risk.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREEDOM BAIL FEES, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR SIMILAR DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE PLATFORM IS LIMITED TO $100 USD OR THE AMOUNT YOU PAID US FOR THE RELEVANT SERVICE IN THE THREE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

22. Indemnification

You agree to indemnify, defend, and hold harmless Freedom Bail Fees, INC. from claims, losses, liabilities, damages, costs, and expenses arising from:

  • Your use or misuse of the Platform.
  • Your User Content or facility entries.
  • Your violation of these Terms, laws, or third-party rights.
  • Your fraud, misconduct, impersonation, or abuse of Platform systems.

23. Dispute Resolution

Binding arbitration may apply in the United States and Canada unless prohibited by law. International users may be subject to local mandatory consumer protections or California jurisdiction as specified by applicable law.

Nothing in these Terms limits rights that cannot be waived under applicable law.

24. Changes to These Terms

We may update these Terms from time to time. We may notify you through the Platform, app store release notes, email, or other reasonable means.

Continued use of the Platform after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.
